- If we want any workflow on our own hardware (local LLM), can you support that, or is it cloud-only?
- What audit logging do you provide that we can show our compliance counsel?
If a vendor cannot answer all eight questions concretely and in writing, you are looking at a marketing demo, not a deployment-ready system.
A decision framework you can actually use
The simplest version of the framework:
- Workflow touches PHI but is operational and routine? Cloud AI with a BAA is appropriate. Verify the BAA, verify the service tier, verify the audit logging. Move forward.
- Workflow touches PHI and is clinical or sensitive? Local LLM is the cleaner answer. Higher upfront cost, stronger compliance posture, lower long-term risk.
- Workflow doesn't touch PHI at all? Cloud AI without a BAA is fine. Public marketing chatbots, generic FAQ tools, anything that isn't tied to a patient identity.
- Workflow is ambiguous? Treat it as PHI until you've confirmed otherwise with your privacy officer or compliance counsel. The downside of being wrong is a HIPAA breach.

The local LLM as a security blanket for things that don't need it. Some practices over-rotate the other way and decide everything has to be on-premise. Local LLMs are not free; they're a real infrastructure investment.
